Persian's Constitution - Chart of Government's Departments,

Power Distribution Chart of Government Branches And Responsibilities

of The United States of Iran / Persia - Work in Progress

The United States of Iran's / Persia's New Model Constitution

We the Iranian / Persian people, wish to institute a direct, bottom to top system of government by the people of Iran / Persia for the people of Iran / Persia, thus forming an ideal Alliance, between all territories of Asia Minor and Central Asia. Leading into establishing a Prosperous, Self-Sustaining, Independent and Democratic system of government, which shall consist of five (5) different and independent branches, Presidential, Environmental Protection, Educational, Judicial and Legislature, controlled and ruled by the democratically and directly elected nine (9) members of the People's Administrative Assembly.

This government shall be responsible for providing National Security, Education, Justice, Legislature, Executive administration and Environmental Protection. It also must safeguard equal rights of all Iranian / Persian citizens, insure domestic tranquility, provide for the common Defense, promote the general Welfare, and secure the Blessings of Liberty for all and Future Generations and to invest with executive authority and establish this Constitution for the United States of Iran / Persia.

Government buildings, apparatus, power and employment opportunities shall be equally distributed between the states all around the country, therefore preventing centralization and preferential treatment of any group or region.


The Future Iran / Persia, A Secular, Democratic And Mullah Free Iran

Democracy, is a social form of governing system formed by the informed and involved people; exercised directly and also through elected representatives. - A true Democracy is where the common people, considered as the primary source of political voice and power. - A true Democracy is the set of governing principles of social, political, and economic equality and respect for the all individuals within a community / country. - The quality and the effectiveness of a true Democracy is directly depends upon the quality of the people, whom are the guardians of their democracy. - Democracy will only succeed and last if it is based on the rule of Law, not Men. - A true Democracy is based on the principles of Laws; - Rules and Regulations - prescribed in the Constitution of such Democracy, voted upon and approved by the guardians of the democracy, the people.


Constitution, is a social contract, a system of fundamental laws and principles that prescribes the nature, functions, and the limits of government branches, the elected and the employed government officials, institutions, private and public entities, and their relationship with The Managing Public; The Iranian / Persian People, who have elect and allow the said officials to administer the prescribed fundamental laws and principles, approved by The Managing Public; The Iranian / Persian People, honestly, precisely, and in a good and honorable manner.


Article - 1 -
Freedom of Speech, Press and Assembly; the rights of individuals to unrestricted freedom of speech, freedom of the press and the right of individuals to peaceful dissent from government itself are absolute, based on the Article -5- Common Sense & Responsibility. No Person or Persons, and None of the Government's Branches shall make any laws at any time prohibiting or abridging the freedom of speech, freedom of press, freedom of peaceful assembly, and freedom to petition the government for a redress of grievances.

Section - 1 -
The absolute principle law of Nature is that Planet Earth belongs to the living. The dead are just that, dead and departed. The living human beings should not live their lives in accordance to the rules, prescribed by the dead and deceased. Therefore all of the United States of Iran / Persia's laws, including the constitution must be re-examined and modified accordingly, if need be, ones every 20 year. Any changes made to the constitution must be approved by at least 65% of the Iranian / Persian people in a national referendum.
Section - 2 -
Religious organizations and religious individuals, of any form, or shape shall not be permitted to participate; directly, or indirectly, in the United States of Iran / Persia's governing system political offices; elected, or selected, and institutions.

Article - 2 -
Human Rights & Gender Equality; under no circumstances, no person or persons, no corporation, and no government branch shall be allowed to claim ownership of any person. No person, or persons shall be allowed to claim ownership of her or his fellow human being as husband, wife, and or slave. All persons, regardless of race, gender, creed, and or religious affiliation are absolutely equal, and must Respect and Honor Inalienable Human Rights and Gender Equality.

Section - 1 -
The rights, welfare and well-being of all children shall be protected by law. No parent shall have the right to abuse or harm his, or her children, physically or psychologically. Parents shall be held responsible for facilitating their children's education, for providing adequate nourishment, shelter, and clothing for their children. Failure to comply will result in punishment by law.
Section - 2 -
No Discrimination; under no circumstances, no person or persons shall be allowed to Discriminate in any form and shape against her or his fellow human being. All persons shall live in peace and harmony as complete and absolute equals.
Section - 3 -
Life, Liberty, Pursuit of Education, Wisdom, Health and Happiness; the Laws of Mother Nature entitle all human beings to a decent dignifying and respectful life. We shall declare these rights to be self-evident, that all human beings have evolved equally, and are endowed by Mother Nature with certain Unalienable Rights; among which, are Life, Liberty, Pursuit of Education, Wisdom, Health and Happiness.

Article - 3 -
Public Education; from kindergarten to college, and graduate school shall be free of charge, regardless of financial circumstance, or family background. The same applies to vocational and technical training schools. Education is the one and only effective defense against the relentless attacks of the religious tyrannical backwardness. The maintenance of an ideal just and proportional representation, a democratic society requires the participation of the entire population, and is based on four (4) essential pillars, education, education, education and education. Such ideal democratic social governing system shall be immune to the paralyzing foreign interventions, covert operations, assassinations, and political, social and economic manipulations.

Section - 1 -
The Iranian / Persian people must aggressively and effectively encourage and promote Respect, Love, Honesty, Honor, Discipline and Patience through public education.
Section - 2 -

Free Public Education is an absolute right of the Iranian / Persian children. Art, music, sciences, poetry, dance, literature, history, philosophy, foreign languages, English in particular, must and shall be universally taught to the Iranian / Persian children, all over the country.
Section - 3 -

Teachers must have minimum of four (4) years college education and two (2) years civil and civic training / education.
Section - 4 -

Teachers compensation must and shall be minimally equal to at least half of the compensation received by the United States of Iran / Persia's administrative assembly team, president and the house of representative members.

Article - 4 -
Universal Healthcare; no Iranian / Persian citizen shall be denied the right to free healthcare services. No law shall ever be made prohibiting or abridging the right of the Iranian / Persian people to free of charge and any obligation, healthcare provided by the Government. We the Iranian people, should never have to worry about medical expenses of getting sick or injured. Under Universal Preventive Healthcare system all Iranians are cover at no cost, the health and well-being of Iranian / Persian citizens must always be the government's top priority. - Iranian medical universities and hospitals must offer the finest care utilizing the best modern equipment. Patients have the right to choose their own doctors and hospital, all Iranians / Persians are assured full medical treatment. Patients if need be can stay in the hospital with a special financial allowance to provide for their family. If patients are suffering from incurable illnesses, they must remain under the public health support for the remainder of their natural life, with no limits.


Article - 5 -
Common Sense & Responsibility; all persons shall use their Common Sense and bear in mind that for every right they enjoy, there is a corresponding law of Responsibility. The law of Responsibility shall provide the necessary balance for all citizens not to misconstrue individual rights as a right of intrusion on other citizens' civil liberties. All individuals shall be free to make choices for themselves as long as the rights of others are respected and not infringed upon. Therefore, people must also accept responsibility for the consequences of their action and the choices they make. Common Sense means inherent good judgment, righteous moral conduct and behavior with reason, to be a good caring and responsible citizen.


Article - 6 -
Women's Inalienable Equal Rights; individual rights should not be denied, or abridged on the basis of sex. No law shall ever be made discriminating against women, such as protective labor laws and marriage or divorce laws, which deny the full rights for women. No law shall ever be made to impose restrictions on free choice and private property or to widen tyranny through reverse discrimination.

Section - 1 -
Recognizing that abortion is a very sensitive issue, women shall in good faith view and consider the consequences of their decision in regard to pregnancy and body. No person, or persons, nor any government branch shall ever make any laws prohibiting women's right to choose. It is the right and obligation of the pregnant woman, not the man, or government, to decide the desirability or appropriateness of prenatal testing, caesarean birth, fetal surgery, voluntary surrogacy arrangements and home births.

Article - 7 -
Sexual Rights; no person, or persons, nor any government branch shall ever make any laws to prohibit, dictate, control, or encourage, people's personal intimate consensual life, living arrangement, or consensual casual sexual relationship. All persons over the age of sixteen (16) with able body and sound minds have the inalienable right to choose consensual sexual partners, activities, and are free to do so, as they see fit with their own body and money, so-long-as no harm is done to the society at large, or to any persons, physically, and or psychologically, nor causes any infringement to the rights of others. Cohabitation shall not be used as a defense against a charge of Rape.


Article - 8 -
Marriage; is a consensual community formed by two, or more people, regardless of race, gender, creed, and or religious affiliation. To marriage community shall require a legal binding civil contract between the participants of the community, to be. Such civil contract shall bind all persons involved as absolute equal partners. The consensual age for any two, or more human beings for marriage shall be at least sixteen (16) years of age. The breadwinner in a marriage community must recognize and respect the rights of her, or his partner as an absolute equal in all aspects of their lives, financially and otherwise.

Section - 1 -
Religious mullahs, dogmas, and traditions, of any kind shall have absolutely no place in determining what marriage legal, and social rules and definitions are in Iran.
Section - 2 -
Coerced marriages under the legal minimum age of sixteen (16) shall be null, void and illegal. Underage consensual marriage shall be null, void and illegal, even with the written consent of minor's parents, or legal guardians.
Section - 3 -
Divorce; any two persons, or more legally bound participants in a consensual marriage community, regardless of race, gender, creed and religion shall reserve the inalienable right to legally file for divorce, seeking separation and restitution. Upon the request for divorce and legal separation, all assets of the people involved shall be frozen until the completion of the divorce proceedings. The complete assets generated and received during the length of their marriage shall be divided equally amongst the participants.

Article - 9 -
Cohabitation; is a consensual community formed by two, or more people, regardless of race, gender, creed, and or religious affiliation, cohabitating and or live and share life together under the same roof, in an intimate sexual relationship regardless of religion or race, shall be protected under the Cohabitation & Marriage Laws, as Equal Partners. The breadwinner in the relationship must recognize and respect the rights of her or his partner as an equal in all aspects of their lives, financially and otherwise.

Section - 1 -
In case of a break up of a cohabitation community, the persons involved must have lived together under the same roof for more than twenty-four (24) months to become eligible for sharing all assets generated and received during the length of such cohabitation. Upon separation, all assets shall be divided equally between the participants.

Article - 10 -
Privacy Rights; the individual's right to privacy, property, and right to speak or not to speak shall not be infringed by any person or persons nor the government. No person or persons nor government shall be allowed to use electronic or other means of covert surveillance of an individual's actions or private activities or property without the written consent of the owner, or the occupant, or a justifiable cause and warrant by court of law. All correspondence, bank and other financial transactions and records, doctor, lawyer communications, employment records, and the like should not be open to review by the government without the consent of all parties involved in those actions.


Article - 11 -
Freedom of Religion; religion is a Private Affair between a person and her or his Belief, and shall remain as such. Freedom of religion shall be protected as one's Private Affair under the first (1) Article of the Iranian / Persian constitution. The rights of individuals to Engage in, or Abstain from, any religious activities that do not violate the rights of others, is protected. A Strict Separation of Religion and Government is a must, therefore there shall never be any law made by the government encouraging actions that either aid or attack any religion.


Article - 12 -
Electoral Trust; shall consist of free and democratically elected members from each state of Iran / Persia. Each state will elect one member to represent them in the Electoral Trust. The Electoral Trust will be the sovereign entity to oversee and implement fair, honest elections and political debates among all eligible, political candidates regardless of their political party affiliation. Therefore the Electoral Trust, as an overseeing committee shall manage and protect the integrity and honesty of national elections. The Electoral Trust shall protect the legislative rights and power of the citizens of Iran / Persia to enact, repeal, and amend public policy, laws, charters, and constitution by local, state and national initiatives that shall not be denied or abridged by anyone.

Section - 1 -
In the first election for the Electoral Trust committee, the elected members shall be divided into two equal groups. The seats of the members of the first group shall be vacated at the expiration of the fourth year. The seats of the members of the second group shall be extended for two more years, thus expiring at the sixth year. All members of the Board of Trustees shall serve for four years except the members of the second group that will serve six years. As of the second election, held after four years, all newly elected members will serve a term of only four years. Go forward, elections will be held every two years to elect half the members of the Electoral Trust committee.
Section - 2 -
Only Iranian / Persian citizens may sponsor an initiative or referendum under the authority of this Article. The people shall have the power to enforce the provisions of this Article by appropriate legislation. No court in Iran / Persia may prohibit or forbid an initiative election except on grounds of fraud.
Section - 3 -
All political parties must be registered with The Electoral Trust in order to become eligible to receive privet and public funds.
Section - 4 -
The Electoral Trust committee shall be responsible for providing funds for qualified and registered political parties and eligible candidates.

Article - 13 -
Political Contributions; only Iranian / Persian citizens are allowed to contribute funds, services, or property in support of, or in opposition to a legislative initiative created under the authority of this Article. All contributions must be transparent and open to scrutiny by the public. Contributions from corporations including, but not limited to, such incorporated entities as industry groups, labor unions, political parties, political action committees, organized religions and associations, are strictly prohibited. Such entities are also prohibited from coercing, or inducing employees, clients, customers, family members, or any other associated persons to support, or oppose an initiative created under the authority of this Article.


Article - 14 -
Instant Runoff Voting Procedure; shall be the procedural means to conduct elections for all elected offices in Iran / Persia. Instant Runoff Voting (IRV) is a voting method that guarantees a winner with a mandate from the majority of voters in any election. Voters simply rank their favorite candidates instead of being forced to vote for only one candidate. Instant Runoff Voting (IRV) is a simple voting technique used to select a single winner from a list of two or more candidates. IRV allows voters to rank the candidates they find acceptable. To determine the winner, voters' first choices are counted. Votes for the last placed candidate are reallocated to the second to last choices on the ballots, and this process is repeated upwards until someone has a majority.


Article - 15 -
Election Laws; Government shall have no control over political parties, consistent with the First Article of The Bill of Rights: freedom of association and freedom of expression. As private voluntary groups, political parties shall be allowed to establish their own rules for nomination procedures, primaries, and political conventions.

Section - 1 -
No person or persons, nor the government shall have the right to suppress voluntary support of candidates and political parties by Iranian / Persian citizens. Political parties shall be under the supervision of the Electoral Trust committee.
Section - 2 -
Political parties that enjoy the support of more than five percent (05%) of the Iranian / Persian registered voters shall be qualified to receive equal matching funds from the Electoral Trust Election Fund. Candidates qualified by showing broad public support, shall be eligible to receive public contributions during their campaign. The maximum legal limit on campaign contributions to political parties and or candidates per election cycle shall be one thousand (1000) unit of monetary value.
Section - 3 -
Eligible voter participation in all elections shall be mandatory. All adult Iranian / Persian citizens have the right to vote upon reaching eighteen (18) years of age. Voters, not the candidates, have the right and ability to modify the technical requirements of the ballot access laws and procedures. Voters should determine who represents them. The enacted election laws shall reduce the influential power of party bosses, officials and their supporters to nothing.
Section - 4 -
Three (3) months prior to the elections, eligible candidates shall be entitled to receive free of charge and or obligation, three (3) intervals of ninety (90) minutes airtime of public radio and television to be scheduled at eight (8pm) and on weekends primetime for debates and general presentation. The Election Day in Iran / Persia shall be a national holiday.
Section - 5 -
No law shall ever be made to support or hinder the competition among political parties. Lack of such competition is particularly dangerous as it enables the government to control the elections of its own administrators and beneficiaries, thereby further reducing its accountability to the Iranian / Persian citizens.
Section - 6 -
Any political party and or public office holder and or candidate receiving or soliciting campaign contributions from special interest groups, foreign sources and governments, corporations, labor unions and organized religious groups is considered an act of treason and punishable by law.

Article - 16 -
Public Office Candidature; the essential, general qualifications and requirements for running for public office shall be that each candidate must be at least a second generation Iranian / Persian citizen born in Iran / Persia, of able body and sound mind, free of any criminal history and records.

Section - 1 -
Since Humankind consists of the womankind and the mankind, with equal rights, therefore Iranian / Persian people must be represented / governed by An Equal number of Women and Men, in all local and national public offices; Government, State and National House of Representatives.
Section - 2 -
Candidate running for People's Administrative Assembly and the office of the President of Iran / Persia, must be at least forty-five (45) years of age when elected.
Section - 3 -
Candidate running for National House of Representatives must be at least thirty-five (35) years of age or over when elected. Candidate running for State's House of Representatives must be at least twenty-five (25) years of age or over when elected and an inhabitant of the State in which she or he is elected.
Section - 4 -
Candidates who are running for any public office must not be employed by the government in any capacity, appointed or elected positions.
Section - 5 -
The Oath of Office; All elected, or appointed officials, President, or Administrative Assembly, or Houses of Representatives, or all branches of military service and civil servants shall take their oaths of office upon the Constitution of the United States of Iran / Persia. Immediately after taking their oaths of office, they shall place their name, signature and date, upon a prepared single page document containing the official position, task and the actual oath taken by them. This signed document must be preserved forever. The ceremony shall be humble, unpretentious and small, in the gathering of friends and family members only.

I, -------------------------, hereby do solemnly swear and declare firmly that, I will faithfully execute the responsibilities of the office of ------------------------------------------------------ of the United States of Iran / Persia, and will to the best of my ability, ethically, honorably and transparently; preserve, protect and defend the Iranian / Persian people and the Constitution of the United States of Iran / Persia.

Article - 17 -
National Energy Guidelines; we must drastically, and immediately alter our energy use. The ecological crisis may be exacerbated past a point of rehabilitation. One of the critical responsibilities of the Department of Energy and Conservation is to create a comprehensive energy policy. Investing in Hydrogen, Wind and Solar Energy is of high priority. Energy Efficiency and Renewable Energy are the keys to sustainability. People must be educated to understand that ecological raw material management is governed by the concept of “Reduce, Reuse, and Recycle”, in priority order. Ecological energy management must be governed by the principle of Conservation, Efficiency, and Clean Renewable material. The highest importance is to use less, then to use wisely, and to have clean production of what is used.


Article - 18 -
Respect and Protection of our Mother Nature; no Person or Persons, and None of the Government's Branches shall make any law causing harm to the environment. We all are responsible for the protection of our planet Earth and safekeeping of the land on which we are completely dependent to sustain life. Collectively all free persons should Honor, Respect and Protect Mother Nature and the environment in which we all live our lives. We all must and shall Love and Care for this interwoven fabric of life made of millions of creatures large and small who inhabit our one and only Home, Planet Earth.


Article - 19 -
Waste Management; is a critical challenge to the survival of all species and our world, therefore the legal requirements and standards for businesses applying to obtain permits and or licenses should be formulated to require disclosure of toxics, which may be used. Past violations, illegal use and or misuse of hazardous materials have to be remedied appropriately.

Section - 1 -
Those responsible for toxic waste dumping, spills, and contamination on or off their sites shall also be responsible for costs of complete and unconditional Clean Up. The violators shall face imprisonment with extensive fines plus the cost of the Clean Up. Those who are found guilty of violating such standards shall lose their rights and permits for owning and operating environmentally sensitive businesses.
Section - 2 -
Significant reductions in per capita consumption of raw materials, and considerable increases in the efficiency with which all materials are used is a must. Recycling at every level of the economy must be supported. Municipal programs and guidelines need to be directed and implemented for the Manufacturers of consumer products to utilize 100% environmentally safe and recyclable materials. The program must also include strict training and education of the consumer to purchase and consume products, which are in support of 100% recycling in all aspects of production. Incineration of municipal solid waste, sewage, non-biological medical waste, and toxic waste shall be prohibited. Shipment Of Toxic / Hazardous and or Radioactive Wastes, shall require strictest regulation, licensing, and supervision by the Environmental Branch.

Article - 20 -
Manufacturing Procedures; all manufacturers, foreign and domestic, of Perishable and Biodegradable Goods who wish to market their products within Iranian / Persian Territories shall be held responsible for their products' safety, the recycling, and reusing of their products' containers and or packaging in any form or shape such as boxes, bottles, cans, and other. All Manufacturers, foreign and domestic, of Non-Perishable Goods shall be held responsible for safely recycling, and the reuse of their products' containers, and the products themselves, such as household appliances, automobiles, computers and more, in a safe environmentally sound fashion according to the Iranian / Persian Environmental Protection Laws.


Article - 21 -
Trade and Globalization; All Foreign Public and or Private Companies, who provide services or manufacture products already available in Iranian / Persian Territories, via domestic production sources, shall be subject to Import Tariffs and Duty Taxation to be determined by the Department of Commerce, Trade & Tariffs. Globalization, in its current model is an Extremely Ruthless and Brutal Silent Takeover of The World's Resources By Greedy Nation-Less Corporations with no conscience. Nation-Less Companies' only goal is to maximize their profit for just a few, at the horrendous costs to millions of other people, with no regards for the environment or the safety of the people.


Article - 22 -
Localization And Individual Capitalism; All laws concerning commerce enacted in all of the Iranian / Persian territories shall be favorable to the support of local communities. The Iranian / Persian people shall always encourage and assist small businesses and local community efforts. Individual responsible capitalism and localized business activities in the form of small business ownership must be supported and encouraged. Globalization and privatization have absolutely no place in the future of Iran / Persia.

Section - 1 -
The order of priority of the five (5) Iranian / Persian branches of government shall always be the protection and preservation of the natural world, human rights and safety. Protection and preservation of our environment, public's rights and democracy shall be the main concern of the five (5) Iranian / Persian branches of government, not monetary gains and or corporate profits.

Article - 23 -
Corporation; shall be formed for two different purposes only: Corporations which are business enterprises and work-for-profit and those, which are formed for the purposes of not-for-profit activities. Corporations are recognized by law only when registered with the Department of Commerce, Trade And Tariffs. Corporations are subject to income taxation and must comply with Iranian / Persian tax laws. Each corporation must state a clear mandate, mission statement and the list of responsible owners and managing executives and Board of Directors.

Section - 1 -
Corporations are recognized as a form of identity for people to come together for the lawful purposes of business enterprise. Corporations are artificial entities and do not possess rights equal to that of human beings and are not recognized as individuals.
Section - 2 -
Corporations shall be registered under the law to function in two (2) different capacities: Publicly Owned Corporations and or Privately Owned Corporations.
Section - 3 -
Privately Owned Corporations shall be registered under the law as privately owned and operated entities for providing lawful services and or trades for profit, or not-for-profit business enterprises under the Department of Commerce, Trade and Tariffs Laws.
Section - 4 -
Publicly Owned Corporations shall be registered under the law to function as public property of the shareholders of such Corporations. Shareholders of any Publicly Owned Corporation are not allowed to own more than one (1%) percent of the shares at any giving time of a Publicly Owned Corporation.
Section - 5 -
Shares of Publicly Owned Corporations are for public ownership only. Therefore no organization, institutional investor, nor government agency or entity shall be allowed to own shares in any Publicly Owned Corporation.
Section - 6 -
Publicly Owned Corporations management team and elected officials must be voted on and approved by the majority shareholders of the corporation directly. All compensations, wage increases, dividends, settlements, expansion plans and employee rewards must be voted on and approved by the majority shareholders of the corporation.
Section - 7 -
Publicly and Privately Held Corporations are not immune from prosecution. Corporation's owners and or CEOs (Chief Executive Officers), CFOs (Chief Financial Officers) and the entire Board of Directors will be held responsible and subject to civil and criminal prosecution for their wrongdoings and any violations of the law by the corporation.

Article - 24 -
No Personal Income Tax Laws; All Iranian / Persian citizens are entitled to keep the fruits of their labor. There shall never be any personal income tax law in all of Iranian / Persian Territories. Personal income tax is a form of extortion therefore it is not allowed and is prohibited. All government activity, which consists of a forcible collection of money or goods in the form of taxation from individuals, shall be in violation of their constitutional and individual rights.


Article - 25 -
United States of Iran / Persia Currency; All Moneys in any form in actual use as a medium of exchange, especially circulating paper money and coins must be decorated by the images of the legendary Iranian / Persian Historic Legends, such as Kourosh The Great the author of the first patriarchal Charter Of Human Rights on Earth, Ferdosi, Hafiz, Khayam, Mollana, Saadie, and alike. No religious images, or symbols of any kind, or images of weapons, wars, or predatory animals shall ever be allowed upon the United States of Iran / Persia's Currency.


Article - 26 -
Consumption And Import Tariff Taxes; the said taxes will generate sufficient income to pay for the cost of government and social services. Obviously as the name suggests, a consumption tax is a tax on spending rather than a tax on income. Consumption taxes are growing in popularity because by exempting investment or savings from taxation, they encourage savings and stimulate capital formation. The justification for consumption taxes rests on the built-in incentives to save and invest. By exempting investment from taxation, consumption taxes encourage investment and discourage wasteful spending. Iran's natural resource exports generate sufficient income. In addition, other chief exports and general taxes on business activities in combination with other proceeds will be more than enough income to pay for the cost of government and social services.


Article - 27 -
Universal Healthcare & Education; no Iranian / Persian citizen shall be denied the right to free healthcare and education services. No law shall ever be made prohibiting or abridging the right to free of charge and any obligation, of healthcare and education for all Iranian / Persian Citizens provided by The Iranian / Persian Government.


Article - 28 -
Military Service; All persons with able body and sound minds must train and serve in the Armed Forces of Iran / Persia as soon as they reach the age of eighteen (18) until they reach sixty (60) years of age. First time of training and service at the age of eighteen (18) shall be for the period of one (1) whole year. Subsequent training and service shall take place once a year for two (2) month intervals. The right of Iranian / Persian citizens, who served and or are serving in the armed forces of Iran / Persia to keep and bear arms, shall not be infringed.

Section - 1 -
No soldier and or Armed Forces personnel, in time of peace shall be allowed to be accommodated in any house, without the consent of the owner, nor in time of war, except in a manner to be prescribed by law.

Article - 29 -
Armed Forces; Military Forces of the United States of Iran / Persia, must have the objective of providing security for the lives, liberty and property of the Iranian / Persian people in Iran / Persia, against the risk of an attack by a foreign power. This objective should be achieved as inexpensively as possible and without undermining the liberties it is designed to protect. The potential use of nuclear weapons is the greatest threat to all the people of the world, not only Iranians / Persians, thus, the objective should be to reduce the proliferation and production of nuclear weapons in the region and on our planet Earth.


Article - 30 -
Declaration of War; the power to initiate military action, calling a State of Emergency or Marshal Law on Iranian / Persian territories, shall be the responsibility of the Legislative Branch for consideration and approval. The War legislation must receive the authorization and signature of at least six (6) of the nine (9) members of the People's Administrative Assembly. The Authorized and Enacted Law shall be the responsibility of the Presidential Branch to execute. Constitutional power of the presidential role is to be The Commander-in-Chief of the Iranian / Persian Armed Forces during Wartime. The Commander-in-Chief role bestows no additional authority on the President.


Article - 31 -
Iran's / Persia's Security and Civil Liberties; the defense of Iran / Persia requires that we have adequate intelligence to defend, detect and to counter threats to national security. This grave responsibility rests on the shoulders of the Department of National Defense. The safeguard of all confidential defensive military plans and related ideas shall be the duty of the Department of National Defense.


Article - 32 -
The Rights To One's Property; there is no conflict between property rights and human rights. Indeed, property rights are the rights of humans with respect to owning property, and as such, are entitled to the same respect and protection as all other human rights. All rights are inextricably linked with property rights. Rights such as freedom from involuntary servitude, as well as freedom of speech and freedom of press are based on self-ownership. Our bodies are our property, every bit as much as are justly acquired land or material objects. And further, the owners of property have the full right to control, use, dispose of, in any safe manner they enjoy, their property without interference, until and unless the exercise of their control infringes on the valid rights of others.


Article - 33 -
Private Ownership and Right to Property; the right of all free Iranian / Persian citizens is absolute and secure in their persons and properties, Houses, Papers and Effects, against unreasonable searches and seizures. These rights shall not be violated. Warrants shall be issued only upon probable cause, supported by oath or declaration of particularly revealing or convincing information resulting in search, and seizure of the persons or properties. Nor shall private property to be taken for public use, without just compensation.


Article - 34 -
Government Secrecy; government's use of classified information withheld from the Iranian / Persian public, to which the Iranian / Persian public are entitled and should have access to, shall be strictly prohibited.

Section - 1 -
No person or persons and or any Government Branch shall violate the Iranians' / Persians' right of privacy or to coerce anyone into revealing confidential or proprietary information to government agents.

Article - 35 -
Right to Due Process of Law; no person shall be tried for the same offense twice (2) and put in jeopardy of life, health, and property. Nor shall she or he be compelled in any criminal case to be a witness against her or him self. Nor shall she or he be deprived of life, liberty, or property, without due process of law.

Section - 1 -
Right to Fair Trial By Jury; in all criminal prosecutions, the accused shall enjoy the right to a speedy and open public trial, by twelve (12) impartial jurists, who shall be selected from the state and district wherein the crime has been committed. The accused shall be informed of the nature and cause of the accusation, and if confronted with the witnesses against her or him, to have compulsory process for obtaining witnesses in her or his support. The accused shall enjoy the assistance of counsel for her or his defense. Until such time as persons are proved guilty of crimes, they should be accorded full respect for their individual rights.
Section - 2 -
Civil Suits; at any given situation where the monetary value in controversy shall exceed one thousand (1000) unit of monetary value, the right of trial by jury shall be preserved. If the amount is less than one thousand (1000) unit of monetary value, the right to arbitration by an official judge is preserved.
Section - 3 -
No Capital Punishment; excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual physical or psychological punishments inflicted. Under no circumstances Capital Punishment shall be imposed on any Iranian / Persian citizen accused and convicted of any crime.
Section - 4 -
Justice for the Individual; the system of criminal law shall be based on Punishment with the highest concern for the Victim. The fullest degree of Restitution possible must be made to the victim at the expense of the criminal or wrongdoer. The victim shall reserve the right to pardon the criminal or wrongdoer. All adult persons with able body and sound mind who are exercising their just rights of Self-Defense shall not be prosecuted.

Article - 36 -
Preferential Treatment, Diplomatic And Political Immunity; there shall be no preferential treatment, diplomatic and political immunity granted to any person or persons. No one, whether Persian / Iranian citizen and or non-Persian / Iranian citizens shall ever be immune from prosecution and be given an above-the-law status. All people at all social level shall be treated equally under the law.


Article - 37 -
Protection of Naturally Grown Substances and Extracted Derivatives; the Laws of Mother Nature are recognized to be superior, therefore no Naturally Grown substance and their Naturally Extracted Derivatives without the use of artificial chemical additives and processes, shall ever be prohibited for use by adult Iranian / Persian citizens over the age of eighteen (18) years old. Substance prohibition is a grave threat to individual liberty, to domestic order and to peace in the world. It will create and promote underground criminal activity for profit. Furthermore, it would provide a rationale by which the powers of government would be expanded to restrict greatly the right to privacy and to be secure in one's homes.


Article - 38 -
Civil Service; all government offices must follow the principle of job rotation in office, increasing the knowledge level of employees, thus preventing the inherent growth of permanent bureaucracy.


Article - 39 -
Unions and Collective Bargaining; the right of free persons to voluntarily establish, associate in, or not associate in, labor unions is protected under the first (1) Article of the Iranian / Persian constitution. The employer has the right to recognize or refuse to recognize, a union as the collective bargaining agent of some, or all, of its employees.

Section - 1 -
Government shall and must not interfere in labor bargaining, such as compulsory arbitration or the imposition of an obligation to bargain. Workers and employers have the right to peacefully organize secondary boycotts if they so choose. Nevertheless, boycotts or strikes do not justify the initiation of violence against other workers, employers strike breakers, and innocent bystanders.

Article - 40 -
Livable Income; Living Wage is the minimum salary that any worker at any workplace in all of the Iranian / Persian territories is entitled to and must receive. All private businesses and government branches and agencies must and shall employ people by calculating their employee's wages based on the estimated Living Wage, Thirty-Five (35) Hours Work Week and Seven (7) Hours Per day. The Living Wage shall be based on the cost of monthly rent for one bedroom apartment, cost of three (3) nutritious meals for two (2) people for thirty days, transportation for two (2) people for thirty days, cost of laundry and other amenities for two (2) people for thirty days multiplied by three (3), and the result divided by three hundred (300) working hours per month shall result into a desirable Living Wage figure which must be paid by all entities who employ people in all of Iranian / Persian territories for all entry-level position jobs. For example:

Let us say for argument's sake the monthly rent of a one bedroom apartment is one thousand (1000) unit of monetary value, and all other costs combined are totaling eight hundred (800) unit of monetary value, the calculating formula should look like this: 1000 + 800 = 1800=> 1800 x 3 = 5400 5400 Divided By 300=> 18 Per Hour Therefore the Living Wage for all entry-level workers shall be eighteen (18) per hour.

Article - 41 -
Referendum; the peaceful submission of a proposed public measure or actual statute to a direct popular vote is an absolute right of the Iranian / Persian people. Government shall and must obey the will and command of the public allowing Referendum of Iranian / Persian people to take place regardless of the issue in question. Under such popular demand and uprising, the Iranian / Persian Armed Forces must and shall protect and defend Iranian / Persian people against all enemies, foreign and domestic. Iranian / Persian Armed Forces shall and must maintain order and security of the people by allowing peaceful direct popular vote to occur. Iranian / Persian Armed Forces shall and must relinquish all government and civilian controls back to the democratically elected civilian authorities immediately when results of Referendum vote are confirmed and have become public knowledge.


Article - 42 -
Affordable Public Housing; we the Iranian people; must build decent affordable housing, especially for young married couples using renewable energy for lighting and heat, sturdy houses, with garden space and children playground around them, which they could then purchase at a very low price with no interest and minuscule monthly payments. These affordable housing must be built to form self-sufficient communities, that includes schools, clinics, individual shops, theater and community centers.

Section - 1 -
Family Friendly Home Ownership; is a plan to reduce stress and encourage healthy family environment. Under such plan the quarter of the couple's mortgage will be canceled with the birth of their each child, therefore after their fourth child is born the couple will become homeowners. Older homes and apartments must be refurbished and upgrade, thereby no slums shall ever come to existence.
Section - 2 -
The Department of Housing & Urban Development shall be responsible for providing low-impact, site-specific designs and development to support human-scale environmentally sensitive planning and appropriate housing initiatives to encourage individual home ownership in the long run. The houses must be designed by taking advantage of clean, renewable energy, complete recycling of sewage and refuse and other environmental considerations.

Article - 43 -
Individual Wealth Limitations; Iranian / Persian citizens, foreign residents, and or anyone who has a history of living and working in Iran / Persia, for 2 years, or more, who have reached a level of social and economic comforts / prosperity of owning their home and possessing a wealth amounting to 5,000,000 Euros, shall be obligated, and must donate all of their extra incomes of all kinds back into the Iranian / Persian society, educational, healthcare, and economic systems. Those who attempt to cheat and escape making the said donation in any form or shape shall be held accountable and as the maximum penalty may lose all of their assets, confiscated in the interests of the country, should they be found guilty of such charges by the Judiciary branch. The names of the wealthy individuals and their donation amount must be acknowledged publicly, at the end of each fiscal year.


Article - 44 -
Nuclear Technologies; we must recognize that there is no such thing as nuclear waste “Disposal.” For example, currently all six (6) of the so-called “Low-Level” Nuclear Waste Dumps in the United States have leaked. There are no technological quick “fixes” which can effectively isolate nuclear waste from the biosphere for the duration of millions of years its hazardous life. As a result, it is essential to stop the generation of additional nuclear wastes. No government branch shall ever make any law allowing Nuclear Power Plans, or Nuclear Weapons' Technologies to proliferate in all of Iranian / Persian Territories.


Article - 45 -
Media: Communication Services, Television, Radio, Newspapers, Internet, Airwaves and Other Iranian / Persian Airwaves are the property of Iranian / Persian people and no entity, government or otherwise shall ever infringe on this right. At no time, any government agency shall be entitled to own or operate any form of media in Iranian / Persian territories.

Section - 1 -
Public Television shall be constituted and programmed by the public and public funding. No law shall ever be made to hinder equal and legal competition among communication services. Lack of such competition would be particularly dangerous, as it would enable the government to control Communications. Public Television shall remain a commercial free media serving the educational and informational interests of the public.
Section - 2 -
All forms of Communication Services, Such as Television, Radio, Newspapers, and more shall require a Separate Leasing License for Operation. No foreign entity or corporation shall ever lease, own or operate any form of media in Iran / Persia.
Section - 3 -
The essential, general qualifications and requirements for inquiring about any of the Communication Services' leasing licenses in all of Iranian / Persian Territories from the Department of Telecommunications shall be as follows: The Person or Persons seeking to inquire a license must be a second generation Iranian / Persian citizen, born in Iranian / Persian territories, of able body and sound mind, and free of any criminal history and records.
Section - 4 -
Department of Telecommunications shall be allowed to issue only one Leasing License per family group. These Leasing Licenses are valid only for 10 years and are subject for renewal after their expiration. Such licenses could be revoked for any violations of the Media laws. No government branch shall ever make any law permitting any Corporation and or business to own and operate any Communication Services within the Iranian / Persian Territories. Nor any person or persons or family groups shall be allowed to own and operate more than one Communication Service entity within the Iranian / Persian Territories.

Article - 46 -
Public Utility ownership; the subscribers and or consumers of regional utility companies such as Water, Electricity, Telephone and Cable Television shall be shareholders and owners of the said companies in their district. Regional and Federal laws shall protect the rights of ownership of the said subscribers and or consumers.


Article - 47 -
Public Radio And Television; a ten (10%) tax shall be imposed on all Radio and Television units at the manufacturing level domestically and at the point of entry on all imported Television and Radio units in order to provide funding for the creation and maintenance of a free, educational and unbiased news gathering and broadcast organization through Public Radio And Television covering all of the Iranian / Persian territories.


Article - 48 -
People's Administrative Assembly; this assembly shall consist of nine (9) members elected directly by popular vote. The nine members shall be responsible to oversee the Presidential, Environmental, Educational, Judicial and Legislative Branches of government. At least five (5) of the nine (9) members of the People's Administrative Assembly must have related and proper education and training for one of the Branches of government. Each member shall serve a term of six years and be allowed to serve only two terms throughout their lifetime.

Section - 1 -
Impeachment; all elected, or appointed officials; such as The President, Vice President, Administrative Assembly, or House of Representatives and all civil servants and officers of the United States of Iran / Persia, shall be removed from office on Impeachment for, and Conviction of, Treason, Bribery, or any other high Crimes and Misdemeanors. The People's Administrative Assembly and Houses of Representatives shall have the right to question any elected or appointed public official and request from the Iranian / Persian people to go to the ballot boxes and vote on the impeachment of that individual. Such proceeding must be transparent and be reported to the Iranian / Persian people upon initiation.
Section - 2 -
Environmental; the Director of the Environmental Branch of Government shall be elected directly by popular vote. The Director shall serve a term of four years and be allowed to serve only two terms throughout his or her lifetime. The Environmental Branch of government shall consist of the following Governmental Departments:
Department of Clean Air & Water
Department of Agriculture
Department of Sewage & Recycling
Department of National Parks & Wild Life
Section - 3 -
Educational; the Director of the Educational Branch of Government shall be elected directly by popular vote. The Director shall serve a term of four years and be allowed to serve only two terms throughout his or her lifetime. The Educational Branch of government shall consist of the following Governmental Departments:
Department of National Education
Department of Science & Research
Department of Endowment for the Arts
Department of National Education Insurance
Section - 4 -
Judicial; the Director of the Judicial Branch of Government shall be elected directly by popular vote. The Director shall serve a term of four years and be allowed to serve only two terms throughout his or her lifetime. The Judicial Branch of government shall consist of the following Governmental Departments:
Department of Justice & Law Enforcement
Department of Records & Property Registry
Department of National Rehabilitation Facilities
Department of Immigration & Naturalization
Section - 5 -
Legislative; the Director of the Legislative Branch of Government shall be elected directly by popular vote. The Director shall serve a term of four years and be allowed to serve only two terms throughout his or her lifetime. The Legislative Branch of government shall consist of the following Governmental Departments:
National House of Representatives - (NHR)
State's House of Representatives - (SHR)

Article - 49 -
NHR & SHR; Each House, National House of Representatives, NHR and the State's House of Representatives, SHR, may determine the Rules of Proceedings, punish its Members for disorderly Conduct, and with the Concurrence of two thirds, expel a Member.

Section - 1 -
Each House must keep an Unambiguous Journal of its Proceedings, and on a quarterly basis publish the same. The Yeas and Nays of the Members of either House on any question and or legislation shall and must be entered in the Journal.
Section - 2 -
Neither House, during the Legislative Session, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.
Section - 3 -
All Legislations must originate from the NHR and approved by at least two thirds of the members, and likewise it shall be reconsidered by the SHR, and if approved by at least two thirds of SHR members, it shall become a Bill ready to be presented for consideration and approval by The People's Administrative Assembly members. At least six (6) out the nine (9) members of the People's Administrative Assembly must approve and sign a Bill before it becomes Law. But if a Bill does not pass, it shall be returned for reconsideration with written Objections to NHR in which it shall have originated.
Section - 4 -
If after such Reconsideration three quarter of NHR members shall agree to pass the Bill, it shall be sent, together with the Objections, to the SHR, by which it shall likewise be reconsidered, and if approved by three quarters of SHR members, it shall become a Law.

Article - 50 -
Presidential Duties and Responsibilities; the President shall be elected directly by popular vote. The President shall serve a term of four (4) years and be allowed to serve only two terms throughout his or her lifetime.

Section - 1 -
The President is obligated to address the Iranian / Persian people at least once a month on the first day of the new month. The President must report to the Iranian / Persian people his or her achievements, failures and future plans in a complete, honest and transparent manner and language.
Section - 2 -
The President heads the Presidential branch of the Government, responsible for managing the following Secretarial positions and forming a cabinet for the following Governmental Departments:
Department of Health & Human Services
Department of National Health Insurance
Department of Housing & Urban Development
Department of Labor & Employment
Department of Peace & Humanity
Department of Foreign Affairs
Department of National Defense
Department of Commerce, Trade & Tariffs
Department of Treasury & Taxation
Department of Natural Resources
Department of Interior & Domestic Affairs
Department of Transportation - Air, Rail & Road
Department of National Communications
Department of Energy & Conservation
Section - 3 -
The President shall conduct her or his duties under the supervision of the nine (9) member People's Administrative Assembly. All of the Secretarial nominees are subject to confirmation by at least six (6) members of the nine (9) members of the People's Administrative Assembly before taking office.

Article - 51 -
Representatives Quarterly Report; the nine members of the People's Administrative Assembly plus the President and the four Directors of the Environmental, Educational, Judicial and Legislative branches of the government must form a committee consisting of themselves only and meet on a quarterly basis (every 3 months) to discuss the business of the government and the people, set new agendas and report to the Iranian / Persian people of the outcome and future plans.


Article - 52 -
Representatives' Line of Succession; when vacancies happen from NHR, SHR and or The People's Administrative Assembly members or the President, The People's Administrative Assembly's Authority thereof shall issue Writs of Election to fill such Vacancies. In Case of the Removal of any elected or appointed official from Office, or Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall delegate to The People's Administrative Assembly, and the NHR and SHR may by Law provide for the Case of Removal, Death, Resignation or Inability, the President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or the member or a President shall be elected.


Article - 53 -
Constitutional Details; the Constitutional details of certain rights shall not be construed to deny or disparage others retained by the people. The powers, which are not delegated to Iran / Persia by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People.


Article - 54 -
To secure the rights of humankind, governments are instituted among human beings, deriving their just powers from the consent of the governed. It is also the fundamental right of humankind to alter or to abolish any government whenever it becomes destructive of the principles of people's liberty, property and human rights, and to institute a new government, laying its foundation on such principles.
